MTN Ghana, has expressed their discontent with the High Court’s ruling on the suit it filed against the National Communications Authority (NCA).

The Accra High Court last Tuesday dismissed the case by MTN, which was seeking the court to quash the decision by the National Communications Authority (NCA) to classify it as a significant market player (SMP) in the telecommunications industry in Ghana.

The court also awarded cost of GH¢10,000 against the giant mobile network company, according to the ruling.

MTN Ghana indicated that although it “respects the decision of the High Court and has full confidence in the Ghanaian judiciary”, it is still unsatisfied, as their “concerns remain unresolved”

The company however did not clarify if it will seek a review or an appeal, except to say that, it will “explore all available options and next steps in this process.

“Having had our day in court, we will refrain from making further statements or comments on this matter at this time, while we explore all available options and next steps in this process”

They vowed to keep customers, shareholders and stakeholders vested with any material development in this matter.

Background

MTN Ghana went for a redress in the law courts following the National Communications Authority’s decision to impose restrictions on its business.

The telecoms giant in a statement issued on Friday, June 26, 2020, stated that the restrictions that have been imposed by the regulator have the potential to inhibit the company’s growth and innovativeness.

This comes after the NCA on June 8, 2020, declared MTN Ghana as a Significant Market Power (SMP), a status that has come with the imposition of special regulatory restrictions on the company.

According to MTN, “the manner of the recent declaration of MTN as a Dominant/SMP raises concerns about clear procedural breaches and substantive issues”.

MTN Ghana said it is not opposed to steps by the regulator to enhance further the highly competitive telecoms industry and is prepared to support the regulator to that end.
